A Santa Fe woman sues the Isotopes for a baseball strike injury

A Santa Fe woman has filed an injury claim against the Albuquerque Isotopes baseball organization. In the woman's lawsuit, which was filed on Wednesday, Aug 16, she alleges that the club failed to take necessary precautions to protect her safety while attending a baseball games at their facility. The woman was struck by a foul ball while watching a game in 2014.

In the woman's lawsuit, she argues that the club should have installed proper safety equipment to ensure that such an incident would not occur. She noted that, when she was struck, the team had yet to install a protective net that similar types of facilities have in place. She argues that had they installed it, it would've potentially protected her from being struck.

The woman also notes that the triple-A team's ownership failed to make any attempt to notify her and other game attendees of the risks associated with them sitting in the seats directly behind the third base line. She alleges that it's along this area of the field that sees a significant amount of errant balls. It therefore poses a higher risk of injury for those who attend games.

The woman was consuming popcorn at the time she was struck by the ball. As a result, most of her injuries she suffered are relegated to her hand.

She has asked the New Mexico district judge presiding over the case to enter a judgment in her favor against the ball club. Among the damages the woman is seeking, she's requested lost wages, compensation for her inability to certain household tasks and to enjoy life similarly to the way she did before.

She's also seeking for the team to reimburse her for her current medical expenses as well as ones she may amass in the future. She's looking to receive noneconomic pain and suffering damages as well. The baseball club has yet to respond to the woman's lawsuit.
